These terms and conditions (the “Terms and Conditions“) govern the relationship between an individual participant to the Oranum Testimonial Campaign (the “Participant”) and, DuoDecad IT Services Luxembourg S.à r.l., a limited liability company incorporated under the laws of Luxembourg, with registered address at 44 Avenue John F. Kennedy, L-1855 Luxembourg Ville, Grand-Duche de Luxembourg, registered in the Luxembourg Trade and Companies register under the number B171358, being hereafter referred to as “Website Operator”) regarding the participation of the Oranum Testimonial Campaign promoting the services of Oranum.com (the “Website“).
Article 1 – Definitions
- Ambassador: a selected Participant who signed the Release form;
- Participant: an individual person who submits a Video according to the requirements laid out in Articles 3 and 4;
- Release form: a contract by which the selected Participant allows the Website Operator to use their Video by granting to the Website Operator a license on the copyrights in their Video and authorizing the Website Operator to use their image in their Video, on the internet and notably on the Website, affiliate websites and social medias, for the purpose of promoting oranum.com. The Release form will be communicated to the selected Participants via e-mail;
- Video: an audiovisual recording of the Participant sharing his personal experience with Oranum.com and submitted according to the modalities laid out in Article 4.
Article 2 – Object of the campaign
The Oranum Testimonial Campaign aims at selecting the best video testimonials (the “Videos) from real Oranum.com users sharing about their experience on the website. The Participants becoming Ambassadors will be rewarded and their Videos will be published on various online medias to promote the Website’s services.
Article 3 – Participants
Participation to the Oranum Testimonial Campaign is free and open to all persons over the age of 18 (21 in some regions) who have an open customer account on the Website.
For the purpose of confirming that the Participant is a true user of the Website, Participants are requested to submit their Video from the same e-mail address they used to register their Oranum account, or to indicate this e-mail address in their submission e-mail.
Article 4 – Modalities of participation
To participate, the Participant should submit their Videos between the 29th of March 2021 and the 30th of April 2021.
Technically, the Participant shall submit two (2) Videos, one being shot vertically (portrait mode) and the other one being shot horizontally (landscape mode).
Each Video shall:
- Be 1 to 4 minutes long,
- Show the Participant only,
- Be sent as a mp4 format.
In the content of the Videos, the Participant should speak about their personal experience with Oranum.com as a user. The Participants are expected to share about the following topics:
- Introduce themself briefly,
- Talk about how they discovered Oranum.com,
- Talk about their favorite features on Oranum.com,
- Talk about their first session with psychics on Oranum.com,
- Talk about how Oranum.com has impacted their life.
The Videos can be submitted via e-mail to marketing@oranum.com. If the files are too large to be sent via e-mail, submissions via www.WeTransfer.com will be accepted.
The Participant warrants that they own all the copyrights and image rights in and to the Videos.
In the submission e-mail, the participant shall write the following sentence: “By sending this video I agree that sensitive data related to my philosophical beliefs might be processed as indicated in the Oranum Privacy Policy of the Campaign”.
Article 4 – Selection criteria
Within 7 days following the closure of the submission period stated in Article 3, the Website’s PR team will select the Videos which will best represent the users’ experience on the Website.
Article 5 – Information to the selected participants
If their Videos are selected, the Participant will be informed via a follow-up e-mail sent to the e-mail address they used to submit their Videos, or another address specified in the body of the e-mail, at the latest on the business day following the selection. If the Participant does not receive a follow-up e-mail within the delays, it shall be considered that their Video was not selected.
In the follow-up e-mail, the selected Participants will be requested to sign the Release Form, enabling the Website Operator to lawfully publish their Videos. The signed Release Form shall be returned via e-mail, within 15 days from the follow-up e-mail. It is agreed that the Videos will not be communicated to the public prior to the reception of the Release Form duly signed by the selected Participant.
Under the condition that the selected Participants duly signed the Release form, they will become Ambassadors and will be entitled to the reward of their choosing, amongst the rewards listed in Article 6.
Article 6 – Rewards
The Ambassadors will receive the reward of their choice, between:
- $25 Amazon gift card, distributed electronically by e-mail, or
- 27.99 Oranum Credit Package, to be added directly on the Oranum.com account attached to the Ambassador’s e-mail.
Article 7 – Data Protection
When the Participant decides to submit a Video, we will collect and process some personal information. Please read carefully our Privacy Policy, which explains how we collect, use and share your personal information and the choices you have regarding the use of your personal data.
Article 8 – Acceptation
By submitting a Video, the Participant fully accepts the present Terms and Conditions.
These Terms and Conditions set forth the full and complete understanding between the Subscribers and the Websites with respect to its subject matter, and supersedes all prior understanding or agreements, whether written or verbal.
Any disputes arising between the Participant and the Website Operator will be settled amicably and only when this solution is not efficient, the competent jurisdiction for the disputes arising from these Terms and Conditions will be the courts of Luxembourg City.
Article 9 – Miscellaneous
Partial invalidity – If any article, clause, paragraph or any other part of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be separated from the rest of these Terms and Conditions and it shall become ineffective, but this shall not affect any other provisions of these Terms and Conditions that shall remain in full force and effect.
Assignment – These Terms and Conditions may be assigned by the Website Operator to any third party without the consent of the Participant.
Governing law and jurisdiction – The parties agree that all questions not regulated in these Terms and Conditions shall be governed by the laws of Luxembourg. The parties agree that all disputes arising out of or in connection with these Terms and Conditions shall be solved amicably. If such solution does not succeed, the parties shall submit their disputes to the competent Luxembourg court.
